Product Disclaimer
The following terms and conditions apply to all sales and use of products, services, digital content, and educational materials offered by The Foot Collective Pty Ltd (ABN 16 629 674 004) ("TFC"). Please read these terms carefully.
These terms include disclaimers of liability and limited warranties. Keeping, using, or allowing use of any TFC product, service, or digital content indicates your acceptance of these terms. If you do not agree, you have 14 days from the date of purchase to return the unused product and/or delete and destroy any downloaded materials, in accordance with our Refund Policy.
Nothing in these terms limits any rights you have under the Australian Consumer Law or equivalent mandatory consumer protection legislation in your jurisdiction.
Defined Terms
"TFC" refers to The Foot Collective Pty Ltd (ABN 16 629 674 004) and any of its affiliated companies, contractors, educators, or agents.
"Products" includes all physical tools, balance equipment, toe spreaders, massage tools, and related physical accessories sold or offered by TFC via its website or other platforms.

High-Risk Activity Warning
TFC's Products and Services are designed for balance training, foot mobility, and general physical health education. Participation in any physical activity carries inherent risks.
You acknowledge and agree that engaging in any form of movement practice, exercise, or use of TFC tools is done at your own risk.
TFC strongly recommends that you consult a registered healthcare professional before starting any fitness program or using TFC Products - particularly if you have pre-existing injuries, mobility restrictions, or underlying medical conditions.
Products should only be used in accordance with the instructions provided in product manuals, video tutorials, or guidance from qualified TFC staff or Guides.
Assumption of Risk
By purchasing or using any TFC Products or Services, you voluntarily and expressly assume the inherent risk of injury, illness, disability, or death that may result from participation in TFC-related activities - whether arising from your own actions, inactions, equipment failure, environmental hazards, or the acts of others.
To the fullest extent permitted by applicable law, you agree to release and hold harmless The Foot Collective Pty Ltd (ABN 16 629 674 004) and its affiliates from any liability, loss, damages, claims, or expenses arising from your use or misuse of any TFC product, service, or related content.
Product Use and Supervision
- TFC Products are intended for use by adults, or by minors only under direct adult supervision by a parent, guardian, or qualified health professional;
- TFC's Products and content are not intended to diagnose, treat, cure, or prevent any disease or condition and should not be interpreted as a substitute for professional medical advice.
Educational Content
TFC's products are sold alongside educational content - including videos, guides, and where applicable, access to digital programs. All such content is educational and general in nature. It does not constitute individualised medical treatment or clinical diagnosis. Results vary between individuals and no guarantee of specific outcomes is made.

Inspection Before Use
All physical products must be inspected before each use. Do not use any product that appears damaged or defective. Contact info@thefootcollective.com immediately if you receive a damaged product.
Fulfilment
Orders are fulfilled through TFC's logistics partners, including Borderless360 for international shipping. Fulfilment partner details may be updated from time to time. Current partners are listed in TFC's Privacy Policy at https://thefootcollective.com/policies/privacy-policy.
Limitation of Liability
To the fullest extent permitted by applicable law, TFC shall not be liable for any indirect, incidental, special, or consequential damages - including but not limited to loss of profits, data, or goodwill - resulting from the use or misuse of any product or service.
Non-excludable consumer guarantees: Under the Australian Consumer Law (ACL), TFC's goods and services come with guarantees that cannot be excluded. If TFC fails to comply with a consumer guarantee, your remedy includes repair, replacement, or refund, and compensation for any reasonably foreseeable loss or damage. UK customers: Under the Consumer Rights Act 2015, you have the right to reject faulty goods within 30 days of purchase for a full refund. After 30 days you are entitled to a repair or replacement, and a refund if repair or replacement fails. These rights apply in addition to these terms and are not affected by any limitation of liability above.
EU customers: Under applicable EU consumer protection law, you have the right to a legal guarantee of conformity for a minimum of two years from delivery. If goods are faulty or not as described, you are entitled to repair, replacement, price reduction, or a full refund. These rights apply in addition to these terms and cannot be excluded.
Nothing in these terms excludes, restricts, or modifies any right or remedy you have under mandatory consumer protection legislation in your jurisdiction that cannot lawfully be excluded.

The collection and use of your personal information in connection with TFC's products and services is described in TFC's Privacy Policy at https://thefootcollective.com/policies/privacy-policy.
Governing Law and Jurisdiction
These terms are governed by the laws of Queensland, Australia. Any dispute or claim related to the purchase or use of TFC Products or Services is subject to the jurisdiction of the courts in Queensland, Australia.
TFC's failure to enforce any part of these terms is not a waiver of its rights.
