Overview

These Terms of Service ("Terms") govern your use of The Foot Collective's website, products, services, digital programs, memberships, and events. By accessing or using any TFC service, you agree to these Terms.

Please read them carefully. They include important information about your rights, our limitations of liability, and how disputes are resolved.


1. Who We Are

These Terms are between you and The Foot Collective Pty Ltd (ABN 16 629 674 004), a company incorporated in Queensland, Australia ("TFC", "we", "us", "our").

Our online store is hosted by Shopify Inc. Shopify provides the technical infrastructure for our e-commerce platform.


2. What These Terms Cover

These Terms apply to:

  • Physical products - foot health tools, accessories, and related products sold through our online store;
  • Digital programs - online courses, recorded video content, and educational materials sold through Kajabi or our website;
  • Memberships - Explorer Membership, Pro Membership, Guide Membership, and any other subscription-based membership;
  • Events - in-person and online workshops, seminars, classes, certifications, and events organised or facilitated by TFC;
  • Website use - browsing, downloading content, and interacting with thefootcollective.com and its subdomains.

Additional or product-specific terms may apply to certain services (such as event participant waivers for in-person events). Where specific terms conflict with these Terms, the more specific terms apply.

For purchases of digital programs, the Digital Program Terms also apply and are available at https://thefootcollective.com/pages/digital-program-terms. Where the Digital Program Terms conflict with these Terms in respect of digital program access, the Digital Program Terms prevail.


3. Accepting These Terms

By visiting our website, creating an account, purchasing a product or service, or attending a TFC event, you agree to these Terms. If you do not agree, do not use our services.

If you are under 18, you must have parental or guardian consent to use our services or purchase our products.

These Terms form a legally binding agreement. We recommend you save or print a copy for your records.


4. International Compliance Notice

Our website is accessible globally. We comply with applicable international product safety regulations.

By purchasing from us, you agree to comply with all applicable local laws and regulations in your country or region, including customs, taxes, import duties, and safety standards.


5. The Educational Nature of Our Services

This is important. Please read it.

TFC is an education company. Everything we do - our products, digital programs, memberships, and events - is educational and informational in nature.

TFC's services do not constitute:

  • medical advice, diagnosis, or treatment;
  • clinical assessment or therapeutic intervention;
  • the practice of any regulated health profession (including physiotherapy, podiatry, chiropractic, or medicine);
  • a substitute for professional medical advice.

Our coaches, Guides, and educators are not providing clinical services. They are providing health education and movement education. Always consult a qualified, registered healthcare professional before making changes to your health or movement routine, particularly if you have a pre-existing injury, condition, or health concern.

Results from TFC's programs vary between individuals. We make no guarantee of specific health outcomes.


6. Products

6.1 Product descriptions

We take care to accurately describe our products. Colours may appear differently on different screens. We reserve the right to correct errors in product descriptions or pricing at any time.

6.2 Pricing

All prices are displayed in the currency of your region (AUD, USD, GBP, EUR as applicable). Prices are subject to change without notice. The price confirmed at checkout is the price you pay.

Applicable taxes (GST, VAT, sales tax) are charged in accordance with the laws of your jurisdiction. For international orders, you may be subject to import duties or customs charges levied by your country's customs authority - these are your responsibility.

6.3 Payment

Payment must be made in full at checkout. We accept major credit cards and other payment methods displayed at checkout. Payment processing is handled securely by Shopify's payment infrastructure. We do not store your card details.

6.4 Order confirmation

A confirmation email will be sent to you after your order is placed. This confirmation constitutes TFC's acceptance of your order and forms the purchase contract between us.

6.5 Availability and cancellations

We reserve the right to limit or cancel orders due to supply issues, pricing errors, or suspected fraud. If we cancel your order, we will provide a full refund to your original payment method.


7. Returns, Refunds, and Exchanges

7.1 Refund Policy

Our Refund Policy forms part of these Terms and is available at https://thefootcollective.com/policies/refund-policy.

7.2 Physical products - refunds and store credit

Physical products may be returned within 60 days of purchase for a full refund to the original payment method, provided the product is in like-new, re-sellable condition - clean, unused, and in its original, intact packaging. Returns between 61 and 90 days of purchase are eligible for store credit (discount code, valid for 12 months from the original purchase date). Returns are not accepted after 90 days. Products must have been purchased directly from TFC's online store.

7.3 Final sale items

The following products are final sale for hygiene reasons and cannot be returned:

  • Wild Toes (toe spreaders) - in any condition;
  • Foot Sacks - in any condition.

7.4 Defective products

All physical products carry a 12-month manufacturing warranty. Defective products will be replaced or refunded as appropriate. Contact info@thefootcollective.com with your order number and photographs.

7.5 Digital programs

Standalone digital programs are generally non-refundable for change of mind after 14 days of purchase. Within the 14-day window, refund eligibility requires no more than 20% of the program to have been completed. If refunded, access will be removed. If a physical tool is returned for a refund, any accompanying digital program access may be suspended.

7.6 Return shipping

TFC covers return shipping for change-of-mind returns, incorrect orders, and faulty items via a pre-paid return label. All returns require prior approval - contact info@thefootcollective.com before returning any item.

7.7 Order cancellations

Contact TFC as soon as possible if you need to cancel an order. If your order has not yet been fulfilled, TFC will cancel and refund in full. If your order has already shipped, the standard return process applies upon delivery.

7.8 Other terms

Memberships are assessed on a case-by-case basis per the relevant membership agreement. Events - see Section 9. Nothing in these Terms limits any rights you have under the Australian Consumer Law or equivalent mandatory legislation in your jurisdiction.


8. Digital Programs and Memberships

8.1 Access

On purchase of a digital program or membership, you are granted a limited, non-exclusive, non-transferable, revocable licence to access the content for your personal, non-commercial use only.

8.2 Prohibited uses

You must not:

  • share your login credentials with any other person;
  • reproduce, copy, distribute, sell, or publish TFC content or materials;
  • screen-record, screenshot, or otherwise capture and share TFC digital content;
  • use TFC content to create competing products or services;
  • sublicence or transfer your access to any third party.

8.3 Platform availability

Digital content is delivered via third-party platforms (primarily Kajabi). We make reasonable efforts to ensure content is available, but do not guarantee uninterrupted access. Platform maintenance, updates, or technical issues may occasionally affect access. Membership fees are not automatically refunded for temporary outages.

8.4 Content changes

We may update, add to, or remove digital content from time to time. Where we make material changes to a paid program or membership, we will notify you in advance.

8.5 Membership cancellation

You may cancel a paid membership at any time. Cancellation takes effect at the end of the current billing period. No refund is issued for unused days within a billing period unless required by law.


9. Events

9.1 Event registration

Event tickets are sold through TFC's website. By purchasing a ticket, you agree to TFC's event terms, including the Participant Waiver which will be presented at the time of purchase and must also be signed physically before the event.

9.2 Independent contractors

Some TFC events are delivered by independent contractors (certified TFC Guides) who are not employees of TFC. TFC provides the brand, methodology, and event infrastructure. Guides are responsible for on-the-ground delivery. Participant Waivers acknowledge this structure.

9.3 Cancellations - by participant

Cancellations made more than 10 days before the event receive a full refund to the original payment method. Cancellations made 10 days or less before the event, or no-shows, receive no refund. For medical emergencies or genuinely unforeseen circumstances, contact info@thefootcollective.com - requests are assessed case by case. All cancellation requests must be made in writing to info@thefootcollective.com.

9.4 Cancellations - by TFC or Guide

Where TFC or a Guide cancels an event, all ticket holders receive a full refund. TFC is not liable for consequential costs arising from event cancellation (such as travel or accommodation bookings made by participants).

9.5 Threshold cancellation

If an event has fewer than five tickets sold nine days before the event date, TFC may cancel the event. Ticket holders will be refunded in full.

9.6 Private and corporate events

Private and corporate events are governed by TFC's Corporate and Private Event Booking Contract, which forms part of the agreement for those bookings.


10. Intellectual Property

All content on TFC's website and platforms - including text, images, video, audio, course content, methodologies, frameworks, training materials, logos, and branding - is owned by or licensed to The Foot Collective Pty Ltd (ABN 16 629 674 004).

You may not reproduce, modify, distribute, display, or create derivative works from TFC's content without our prior written consent.

User submissions (reviews, comments, content you post in TFC community spaces) remain your property but you grant TFC a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce them in connection with TFC's services.


11. User Conduct

By using TFC's services, you agree to:

  • comply with all applicable laws;
  • not post or transmit harmful, defamatory, obscene, or illegal content;
  • not attempt to gain unauthorised access to TFC's systems or other users' accounts;
  • not use TFC services to send spam, malware, or unsolicited commercial communications;
  • not impersonate TFC or any other person;
  • not use automated tools to scrape or extract TFC content.

We may suspend or terminate your access to TFC services if you breach these obligations, without notice.


12. Limitation of Liability

12.1 General limitation

To the maximum extent permitted by law, TFC's total liability to you for any claim arising under these Terms (whether in contract, tort including negligence, statute, or otherwise) is limited to the greater of:

  • the amount you paid to TFC for the specific product or service giving rise to the claim, in the 12 months before the claim arose; or
  • AUD $100.

12.2 Exclusion of consequential loss

To the maximum extent permitted by law, TFC is not liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising from your use of TFC's services.

12.3 Consumer guarantees - non-excludable

Nothing in these Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by any legislation (including the Australian Consumer Law, UK Consumer Rights Act 2015, and EU Consumer Rights Directive) that cannot lawfully be excluded or limited.

If TFC breaches a non-excludable consumer guarantee, TFC's liability is limited (to the extent permitted by law) to: resupplying the goods or services; or paying the cost of having them resupplied.

12.4 Death or personal injury

Nothing in these Terms limits TFC's liability for:

  • death or personal injury caused by TFC's negligence (or the negligence of its employees or agents);
  • fraud or fraudulent misrepresentation;
  • any other liability that cannot lawfully be excluded.

13. Indemnity

You agree to indemnify and hold harmless TFC and its directors, officers, employees, agents, and contractors from any claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising from:

  • your breach of these Terms;
  • your use or misuse of TFC's services;
  • any third-party claim arising from your conduct.

Our website may contain links to third-party websites or services. We are not responsible for the content, accuracy, or practices of third-party sites. Links do not constitute endorsement.


15. Governing Law

These Terms are governed by the laws of Queensland, Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland, Australia for the resolution of any disputes.

For EU and UK customers: Nothing in this clause affects any mandatory consumer protection rights you have under the laws of your country of residence. Mandatory provisions of EU consumer law apply regardless of governing law choice.

For US customers: State consumer protection laws apply as mandatory law in each US state. The choice of Queensland law does not override mandatory state-level consumer protections.


16. Dispute Resolution

Before commencing any legal proceedings, you agree to contact TFC at info@thefootcollective.com and allow us 30 days to attempt to resolve the dispute in good faith.

If a dispute is not resolved within 30 days:

  • Disputes involving amounts up to the small claims threshold in your jurisdiction may be referred to the relevant small claims court or tribunal;
  • Other disputes shall be subject to the jurisdiction of the courts of Queensland, Australia, or, by agreement, binding arbitration under the Australian Centre for International Commercial Arbitration (ACICA) rules.

17. Amendments

We may amend these Terms at any time by posting an updated version on our website. The "Last Updated" date at the top will reflect the most recent version.

For material changes, we will notify you by email or a prominent website notice at least 30 days before changes take effect.

Your continued use of TFC's services after changes take effect constitutes your acceptance of the updated Terms.


18. General

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.

Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to enforce it in the future.

Entire agreement: These Terms, together with our Privacy Policy, Refund Policy, and any service-specific agreements, constitute the entire agreement between you and TFC regarding our services.

Assignment: You may not assign your rights under these Terms. We may assign ours in connection with a business sale, merger, or restructure.
